This CALIFORNIA PRIVACY STATEMENT supplements the information contained in the Privacy Policy of YKK Group companies ("we," "us" and "our"), and applies solely to those who reside in the State of California. We adopt this notice to comply with the California Consumer Privacy Act of 2018, California Civil Code §1798.100, et seq., ("CCPA"), California Privacy Rights Act of 2020 (Proposition 24) (“CPRA”),and other California privacy laws. Any terms defined in the CCPA and CPRA have the same meaning when used in this notice.

1. Personal Information Collected

Under California law, we are required to provide information about the categories of personal information we have collected in the past twelve (12) months. We have collected the following categories of personal information:

We obtain the categories of personal information listed above directly from you through forms hosted on our website, ykk.co.jp.

3. Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following purposes:

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

4. Sharing Personal Information

We may share your personal information by disclosing it to a third party for a business purpose. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract. In the preceding twelve (12) months, YKK Group has shared or disclosed the below categories of personal information with other YKK Group subsidiaries, parents and affiliates for a business purpose.

The CCPA prohibits a third party from reselling personal information unless you have received explicit notice and an opportunity to opt out of further sales.

5. Cross-border Data Transfer

Each YKK Group company may transfer personal information to our overseas bases, or to other foreign countries. Personal information to be transferred includes data on customers, business partners, and employees in our Group. YKK Group companies will legally transfer this data in accordance with applicable laws and regulations. You acknowledge you understand that by providing your personal information: (i) your personal information will be used for the uses identified above in accordance with this CALIFORNIA PRIVACY STATEMENT; and (ii) your personal information may be transferred to other jurisdictions as indicated above, in accordance with applicable law.

6. Your Privacy Rights

If you wish to request disclosure, correction, addition, deletion, suspension of use, erasure, suspension of third-party provision, exercise of any claim or other right specified by other laws or regulations, or notification of the purpose of use (hereinafter referred to as "Claims, etc.") with respect to the contents of the retained personal information held by each YKK Group company, please contact us regarding personal information protection (https://www.ykk.com/inquiry/p_form/input) or contact the YKK Group companies listed below. A reasonable fee may be applied if permitted by applicable law.

In particular, California residents have the following rights:

  • Right to Know: California consumers have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you the categories and specific pieces of personal information we have collected about you, as well as the categories of sources from which such information is collected, the purpose for collecting such information, the categories of third parties with whom we share such information, and information about our sale or disclosure for business purposes of your personal information to third parties. Through January 1, 2023, we do not provide a right to know or data portability disclosure for B2B personal information.
  • Right to Delete: California consumers have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. Through January 1, 2023, we do not provide these deletion rights for B2B personal information.
  • Right to Opt-Out of Sale: California consumers have the right to opt-out of the sale of your personal information to third parties. Please note we do not "sell" your personal information, as that term is defined in the CCPA.
  • Right to Non-Discrimination: California consumers have the right to not be discriminated against for exercising any of these rights.
  • Right to Correct Inaccurate Personal Information: California consumers have the right to submit a request to correct any inaccurate personal information. A request to make a correction is not absolute and must take the personal information’s processing purposes and general nature into account. Once we receive and confirm your verifiable consumer request, we will make the requested correction subject to any further guidance provided by the California Privacy Protection Agency in responding to any correction requests.
  • Right to Opt-Out of Sharing Personal Information for Cross-Context Behavioral Advertising Purposes: California consumers have the right to opt-out of the sharing of your personal information with third parties for a cross-context behavioral advertising purposes.
  • Right to Restrict Sensitive Personal Information Use and Disclosure: California consumers have the right to restrict the use and disclosure of sensitive personal information to only actions necessary to perform the specific purposes listed in the CPRA. The restriction does not apply to sensitive personal information that we collected or processed without the purposes of inferring characteristics about you. After receiving a limitation request, we will only be able to use your sensitive personal information with your consent.

We may need you to provide additional information to verify your request, such as providing certain data elements so that we can confirm they match the personal information already maintained by us. We will not use this additional information for anything other than handling your request. Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You may designate an authorized agent to make a request in certain circumstances on your behalf. Such authorized agent must be registered with the California Secretary of State.

We will confirm receipt of your request within 10 business days. In the event that you do not receive a confirmation within the 10-day timeframe please contact us at the website or email address provided in this CALIFORNIA PRIVACY STATEMENT. We will provide information on action taken on these requests without undue delay and in any event within 45 days of receipt of the request. That period may be extended once by 45 where necessary, taking into account the complexity and number of the requests. We will inform you of any such extension within 45 days of receipt of the request, together with the reasons for the delay.

Additionally, California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our website that are California residents and who have an established business relationship with us to request, once a year, certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their direct marketing purposes.

Some websites of YKK Group companies feature content such as chats, forums (conference room), bulletin boards, news groups and e-mail exchanges (collectively, "public posting areas"). If we make material changes to this Privacy Policy, we will notify you either through the email address you have provided us or by means of a prominent notice on the Website.
